Terms of Service

Applies to: the public website at https://www.forever-canadian.ca, the supporter sign-up flow it operates, and any other web pages or digital services published under the forever-canadian.ca domain that link to these Terms (collectively, the “Website”).
These Terms of Service (“Terms”) form a legal agreement between you and Forever Canadian (“Forever Canadian”, “we”, “us”, “our”). By accessing the Website, registering on our supporter list (the “List”), or otherwise using the Website, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

1. About Forever Canadian
Forever Canadian is a non-partisan, citizen-driven civic mobilization initiative dedicated to affirming Alberta’s place within a strong, united, and sovereign Canada. Forever Canadian is not affiliated with any political party, candidate, or electoral campaign. Forever Canadian is not a registered charity under the Income Tax Act (Canada).

2. Eligibility and accurate information
To register on the List or otherwise submit information through the Website, you confirm that:
- you are at least 18 years old, or the age of majority in your province or territory of residence, whichever is greater;
- you are using the Website in your personal capacity, on your own behalf;
- the personal information you provide (name, email, phone, postal code, consent status) is true, accurate, current and complete;
- you have the right and authority to provide that information (for example, the email address and phone number belong to you, or you are otherwise authorized to use them); and
- you will keep your contact information current to the extent reasonably possible.
If we have reason to believe that information you submitted is false, inaccurate, or fraudulent — or that your registration was made by an automated agent — we may refuse, suspend, or remove the registration without notice.
We do not knowingly collect personal information from anyone under the age of 14. The Sign-Up Form and the List are intended for adults who can legally consent to receive electronic communications under Canada’s Anti-Spam Legislation (CASL) and applicable provincial law.
3. Registration on the List
When you submit the Sign-Up Form on the Website, the following happens:
- You provide your first name (required), last name (optional), email address (required), mobile phone number (optional, Canadian numbers only), postal code (required, Canadian format), and you confirm your express consent to receive updates from the Forever Canadian movement by checking the consent box.
- Your submission is validated and protected by industry-standard anti-abuse controls. We do not publish details of those controls.
- Your record is stored in our supporter database. If a record already exists for the same email address, your record is updated (de-duplicated) so that we keep one entry per email.
- If your email address is brand new to the List, we send you a one-time welcome email confirming your sign-up.
- From time to time we send updates about the Forever Canadian campaign, upcoming events, milestones, volunteer opportunities and, where applicable, voting and referendum information, to the email address you registered (and, if you provided one and consented to that channel, your mobile phone number).
- Every commercial electronic message we send you contains a working unsubscribe mechanism. You may also unsubscribe at any time at https://www.forever-canadian.ca/unsubscribe or by emailing info@forever-canadian.ca with the subject “Unsubscribe”.
By submitting the Sign-Up Form you acknowledge that:
- the personal information you submit will be handled in accordance with our Privacy Policy;
- your consent to receive emails (and SMS, if applicable) is given freely and may be withdrawn at any time without affecting the lawfulness of any communication sent before the withdrawal;
- you may receive an immediate confirmation that your sign-up was accepted, even where additional processing (such as sending the welcome email) happens asynchronously in the background.
We may decline, suspend, or delete a registration where we reasonably believe the registration was made fraudulently, in violation of these Terms, or in violation of applicable law. If we decline a registration, we will normally only retain enough information to demonstrate why the registration was rejected.
4. Communications and CASL consent
Forever Canadian complies with Canada’s Anti-Spam Legislation (CASL) and equivalent provincial requirements when sending you commercial electronic messages.
By registering on the List you give us your express consent to receive electronic communications from Forever Canadian to the email address (and, if you provided one and the relevant phone number is configured for SMS, the mobile phone number) you registered. Such communications may include, without limitation:
- a welcome message confirming your sign-up;
- campaign updates, news, and milestones;
- invitations to events, volunteer opportunities, and other community engagement;
- reminders, voting information, and referendum information where applicable;
- requests for support or contributions, subject (to the extent applicable to our fundraising activities) to Alberta’s Charitable Fund-raising Act (RSA 2000, c C-9) and its regulation, and (where applicable) Alberta’s Election Finances and Contributions Disclosure Act; and
- information about how Forever Canadian operates, including changes to these Terms or to our Privacy Policy.
Every commercial electronic message will identify Forever Canadian as the sender, include our mailing address, and include a working unsubscribe mechanism that we will honour within 10 business days. You may unsubscribe at any time through the link in any email, the unsubscribe page on the Website, or by writing to info@forever-canadian.ca with the subject “Unsubscribe”.
Withdrawing consent does not affect the lawfulness of any communication sent before the withdrawal, and does not delete your record from the List automatically — see Section 9 (Retention) of the Privacy Policy and your rights in Section 11 of the Privacy Policy if you also wish to request deletion.
5. Acceptable use — what you may do
You may use the Website to:
- read information about the Forever Canadian campaign;
- register on the List in your personal capacity, with accurate information;
- exercise the unsubscribe and re-subscribe controls available on the Website;
- contact Forever Canadian by email or other channels we publish; and
- share links to the Website with friends, family, and your community for non-commercial civic-engagement purposes related to the Forever Canadian movement.
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Website for these purposes only.
6. Acceptable use — what you must not do (Prohibited Conduct)
When using the Website, you agree that you will not:
- submit false, misleading, fraudulent or impersonating information through the Sign-Up Form or any other contact channel;
- register another person on the List without their consent, or use someone else’s email address or phone number without authority;
- use, attempt to use, or facilitate the use of the Website for any purpose unrelated to the Forever Canadian movement;
- harass, threaten, defame, intimidate, or attempt to extract personal information about Forever Canadian personnel, volunteers, or other Supporters;
- attempt to gain unauthorized access to any account, system, or data on the Website, our service providers, or any related infrastructure;
- circumvent, disable, probe, test, or interfere with any security or anti-abuse feature of the Website, however implemented;
- use any automated means (robots, scrapers, spiders, headless browsers, AI agents) to access, copy, scrape, mass-submit, or otherwise interact with the Website, except with our prior written permission;
- copy, reproduce, scrape, or harvest the email addresses, phone numbers, or other personal information of Supporters or anyone else through the Website;
- post, transmit, or otherwise convey through the Website any content that is unlawful, defamatory, hateful, discriminatory, harassing, threatening, obscene, or that infringes the intellectual property or privacy rights of any third party;
- interfere with the operation, integrity, security, or performance of the Website, our service providers, or any related infrastructure (for example, by submitting malformed payloads designed to exploit a vulnerability, or by intentionally flooding endpoints);
- perform any security research, vulnerability scanning, or penetration testing against the Website without our prior written permission and a coordinated disclosure agreement;
- decompile, disassemble, reverse-engineer, or otherwise attempt to derive source code or trade secrets from the Website;
- use the Website in violation of any applicable Canadian, Albertan, or other applicable law (including, without limitation, the Criminal Code (Canada), PIPA, PIPEDA, CASL, the Charitable Fund-raising Act, and the Election Finances and Contributions Disclosure Act).
We may suspend or terminate your access to the Website at any time, with or without notice, for any actual or suspected violation of these Terms or applicable law.
7. Donations and tax treatment
The Sign-Up Form on the Website does not process donations. Donations to Forever Canadian are processed through our separate donations portal at https://secure.forever-canadian.ca, which has its own Donation Terms and Privacy Policy. Please read those terms before donating.
Forever Canadian is not a registered charity under the Income Tax Act (Canada). Donations to Forever Canadian are not tax-deductible and we cannot issue a charitable tax receipt. We may issue a transaction receipt confirming the date, amount, and payment method of a donation.
To the extent applicable to our fundraising activities, Forever Canadian complies with the disclosure obligations of Alberta’s Charitable Fund-raising Act (RSA 2000, c C-9) and its regulation and, where applicable, the record-keeping and reporting obligations of Alberta’s Election Finances and Contributions Disclosure Act. Solicitation disclosures required by the Charitable Fund-raising Regulation are published on the donations portal and provided in any solicitation made on our behalf.
8. Intellectual property
8.1 Forever Canadian content
Except for User Content (defined in Section 8.2) and third-party content noted as such, all content on the Website — including the text, images, video, illustrations, logos, wordmarks, design, layout, source code, and the “Forever Canadian” / “Canadiens Pour Toujours” names and marks — is owned by or licensed to Forever Canadian and is protected by Canadian and international intellectual-property laws. All rights are reserved.
You may share and reproduce our content for non-commercial purposes related to supporting the Forever Canadian movement, provided you (a) do not modify the content in any misleading way, (b) do not remove any copyright, trademark, or attribution notices, and (c) attribute the content to Forever Canadian. Any other use — including any commercial use, mass redistribution, derivative-work creation outside the scope above, or use that suggests endorsement of a product, service, party, or candidate — requires our prior written consent.
The Forever Canadian wordmark, the Canadiens Pour Toujours wordmark, and any associated logos are trademarks of, or used under licence by, Forever Canadian. Nothing in these Terms grants you a licence to use these marks except as expressly permitted above.
8.2 User Content
The public Website does not offer a public posting feature; the principal user input on the public Website is the Sign-Up Form and replies to email or other contact channels. To the extent you submit any content to us — for example, a question or comment by email, a feedback form submission, a photograph attached to an email, or a testimonial you offer to be featured on the Website (“User Content”) — you confirm that:
- you own or have the necessary rights to the User Content;
- the User Content does not infringe any third-party intellectual-property, privacy, or publicity right; and
- you grant Forever Canadian a non-exclusive, royalty-free, worldwide, perpetual, sub-licensable licence to use, reproduce, adapt, publish, translate, display, and distribute the User Content in connection with the operation, promotion, and lawful purposes of the Forever Canadian movement, subject to our Privacy Policy.
You retain ownership of your User Content. We are not obligated to use any User Content you submit, and we may decline, edit, or remove User Content at our discretion.
8.3 Reporting infringement
If you believe content on the Website infringes your intellectual-property rights, please contact info@forever-canadian.ca with: (a) the URL of the alleged infringing content, (b) a description of the work allegedly infringed, (c) your contact information, and (d) a statement that you have a good-faith belief the use is unauthorized.
9. Third-party services and links
9.1 Service providers behind the Website
The Website is delivered using a number of third-party service providers. Your use of those services, where you interact with them directly, is subject to their respective terms and privacy policies. The current categories of service providers we engage are identified by name in our Privacy Policy. For security reasons we do not publish the role each service provider plays in our infrastructure.
9.2 Other Forever Canadian properties — separate terms apply
These Terms govern the public website at https://www.forever-canadian.ca and the supporter sign-up flow it operates. They do not govern any of the following separately operated Forever Canadian properties, each of which has its own Terms of Service / Terms of Use and Privacy Policy published at the relevant domain:
- Donations Portal — https://secure.forever-canadian.ca, governed by the Donation Terms and Donations Privacy Policy published there.
- Volunteer / Team Platform — https://team.forever-canadian.ca, governed by the Volunteer Agreement, Code of Conduct and the policies published there. Access is invitation-only and reserved for approved volunteers. Team-platform inquiries should be directed to team@forever-canadian.ca.
- Forever Canadian Store — https://store.forever-canadian.ca, an e-commerce store offering Forever Canadian branded merchandise. The Store is operated separately from this Website and is hosted on a third-party e-commerce platform; orders, payments, delivery, returns, refunds, customer-service inquiries and personal-information handling for the Store are governed exclusively by the Store’s own privacy policy, the Store’s refund / return policy, and any additional terms or policies the Store publishes from time to time. Store-related inquiries should be directed to store@forever-canadian.ca.
If you access any of those properties, you do so subject to the terms and privacy policies of that property — not these Terms.
9.3 Other third-party links
The Website may also contain links to other third-party websites — for example, social-media profiles, news articles, or partner organizations. Those websites are not under our control, and we are not responsible for their content, privacy practices, terms, accuracy, or availability. The presence of a link does not imply our endorsement of the linked site.
10. Bilingual content (English / French)
The Website is published in English and French. We strive to keep the content of both versions identical, but in the event of any inconsistency between the English and French versions, the English version of these Terms and the Privacy Policy shall prevail to the extent permitted by applicable Canadian and Albertan law.

Nous nous efforçons de maintenir un contenu identique dans les deux versions, mais en cas d’incohérence entre les versions anglaise et française, la version anglaise de ces conditions et de la politique de confidentialité prévaudra dans la mesure permise par les lois canadiennes et albertaines applicables.
11. No partisan affiliation
The Forever Canadian movement is non-partisan. Nothing on the Website, in our communications, or in our solicitations, is intended as an endorsement of, or a contribution to, any political party, candidate, or electoral campaign. Where any contribution might be regulated under Alberta’s Election Finances and Contributions Disclosure Act or equivalent legislation, separate eligibility, disclosure, and record-keeping rules apply, and we comply with those rules.
12. Disclaimers — “as is” and “as available”
To the fullest extent permitted by applicable law:
- The Website is provided “as is” and “as available”, with all faults and without warranty of any kind.
- We make no representations or warranties, express or implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency, or uninterrupted or error-free operation.
- We do not warrant that the Website will be available at any particular time, will be free of bugs, errors, or security vulnerabilities, or that any defects will be corrected.
- Information published on the Website is provided for general informational and civic-engagement purposes. It is not legal, financial, tax, or professional advice. You should consult an appropriate professional before relying on any of it for a decision that has legal, financial, or other significant consequences.
Some jurisdictions do not allow the exclusion of certain warranties; if any of the above exclusions are unenforceable in your jurisdiction, they apply to you only to the maximum extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by applicable law, in no event will Forever Canadian, our organizers, directors, officers, staff, contractors, volunteers, or service providers be liable to you or any third party for:
- any indirect, incidental, consequential, special, exemplary, aggravated, or punitive damages of any kind;
- any loss of profits, revenue, opportunities, savings, data, goodwill, or use;
- any damages arising from: (i) your use of, or inability to use, the Website; (ii) any unauthorized access to, alteration of, or loss of your transmissions, registration, or personal information; (iii) statements or conduct of any third party on or through the Website; (iv) any content posted, displayed, or otherwise made available through the Website; or (v) any other matter relating to the Website,
whether based in contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Website shall not exceed the greater of (i) one hundred Canadian dollars (CAD $100) or (ii) the total amounts (if any) paid by you to Forever Canadian in the twelve (12) months preceding the event giving rise to the claim. Most Supporters of the Website pay nothing to Forever Canadian, in which case (i) applies.
Some jurisdictions do not allow the exclusion or limitation of certain damages; if any of the above limitations are unenforceable in your jurisdiction, they apply to you only to the maximum extent permitted by law. Nothing in these Terms limits any liability that cannot be limited by law (for example, fraud, willful misconduct, or liability arising from death or personal injury caused by negligence, where applicable).
14. Indemnity
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Forever Canadian and its organizers, directors, officers, staff, contractors, volunteers, and service providers from and against any and all claims, demands, actions, liabilities, judgments, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- your access to or use of the Website;
- your registration on the List or any information you submit to us;
- any content you submit, transmit, or otherwise make available through the Website;
- your breach of these Terms or any applicable law; or
- your infringement of any third-party right, including any intellectual-property, privacy, or publicity right.
We reserve the right to assume the exclusive defence and control of any matter otherwise subject to your indemnification, in which case you will reasonably cooperate with us at our request and expense.
15. Termination and suspension
You may stop using the Website at any time and unsubscribe from the List as described in Section 4 and in our Privacy Policy.
We may, at our sole discretion and at any time, with or without notice and with or without cause, suspend, restrict, or terminate your access to the Website (or any part of it), remove your registration from the List, or refuse to send you communications, including where we reasonably believe that:
- you have violated these Terms or applicable law;
- your registration is fraudulent, automated, or otherwise illegitimate;
- continuing to provide service to you exposes Forever Canadian, our service providers, or other users to legal, security, reputational, or operational risk; or
- we are required to do so by law or by an instruction from a regulator or court of competent jurisdiction.
Sections that by their nature should survive termination — including Sections 8 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnity), 16 (Governing Law) and 17 (Dispute Resolution) — shall survive any termination of these Terms.
16. Governing law and forum
These Terms, the Privacy Policy, and your use of the Website are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
Subject to Section 17 (Dispute Resolution), each of you and Forever Canadian irrevocably submits to the exclusive jurisdiction of the courts of the Province of Alberta sitting in the Edmonton Judicial Centre for any dispute arising out of or in connection with these Terms or the Website, and waives any objection to the laying of the venue of any proceeding in those courts on the basis of forum non conveniens or otherwise.
The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
17. Dispute resolution — informal resolution first
Before commencing any formal proceeding, you agree to try to resolve any dispute with us informally by emailing info@forever-canadian.ca with the subject “Dispute Notice”, a clear description of the issue, and the resolution you are seeking. We will attempt in good faith to respond within thirty (30) days. Many concerns can be resolved this way without legal action.
Nothing in these Terms prevents either party from seeking emergency or interim injunctive relief from a court of competent jurisdiction, or from pursuing any complaint with a regulator (including the Office of the Information and Privacy Commissioner of Alberta, the Office of the Privacy Commissioner of Canada, or the Canadian Radio-television and Telecommunications Commission).
18. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices, the Website, or applicable law. The updated version will be posted at https://www.forever-canadian.ca/en/terms (or a successor URL) with a new “Effective date” above. Material changes will be highlighted at the top of the page for a reasonable period.
If you continue to use the Website (including by remaining on the List) after a change becomes effective, you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Website and unsubscribe from the List.
19. General
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Forever Canadian relating to your use of the Website, and supersede any prior agreement on that subject.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall continue in full force and effect.
No waiver. A failure by Forever Canadian to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms to an affiliate or successor in connection with a corporate reorganization, restructuring, merger, or transfer of substantially all of our assets or activities.
No third-party beneficiaries. Except as expressly stated in these Terms, no third party is a beneficiary of these Terms.
Headings. Section headings are for convenience only and do not affect interpretation.
Notices. Notices to Forever Canadian must be sent to info@forever-canadian.ca and to PO Box 3313, PO Main, Sherwood Park, Alberta T8H 2T2, Canada. Notices to you may be sent to the email address on your List record or, if none, posted publicly on the Website.
Language. The parties have requested that these Terms and all related documents be drawn up in English. Les parties ont demandé que ces conditions et tous les documents connexes soient rédigés en anglais. Subject to Section 10, the English-language version prevails over the French-language version in case of inconsistency.
